Agreement with Bitwise Security Pty Ltd

1. Sponsorship agreement. This agreement is between Bitwise Security Pty Ltd (the Organiser) and the Sponsor and remains valid from electronic acceptance until the end of BSides Sydney 2026.
2. Marketing use. During the agreement, the Sponsor may describe itself as an “Official Sponsor of BSides Sydney 2026” at the purchased tier.
3. Production deadlines. The Sponsor must provide its logo, website URL and applicable promotional materials within 10 business days of payment and no later than six weeks before the event.
4. Sponsor branding. The Sponsor authorises the Organiser to use its name, trademarks, logo, tagline and supplied graphics solely to deliver the purchased benefits.
5. Promotional materials. Branding may be used on the website, electronic runsheet, signage and other items expressly included in the purchased tier.
6. Web links. The Sponsor may link to BSides Sydney and Security BSides websites, provided those links are accurate and do not imply endorsement.
7. Payment. Full payment is required to secure sponsorship. A package is not reserved until Stripe confirms successful payment.
8. Non-endorsement. Sponsorship does not constitute endorsement of the Sponsor or its products, services or programs by the Organiser, BSides Sydney or Security BSides.
9. Non-exclusivity. Sponsorship is non-exclusive. The Sponsor must not imply an exclusive or preferential relationship.
10. Attendee information. The Organiser will not provide attendee names, email addresses or other attendee contact information to sponsors.
11. Limited liability. To the extent permitted by law, the Organiser’s aggregate financial liability arising from this sponsorship will not exceed the sponsorship fee paid. The Organiser is not responsible for the Sponsor’s travel, accommodation, staffing, freight, production or consequential expenses.
12. Force majeure. Neither party will be in default where performance is delayed or prevented by circumstances outside its reasonable control.
13. Rejection. The Organiser may reject an application inconsistent with the event’s values, reputation or community objectives. A rejected application will receive a full refund.
14. Entire agreement. The selected package, these terms and any written attachments constitute the entire agreement.
15. Electronic acceptance. Entering the representative’s details, selecting the acceptance checkbox and completing payment constitutes electronic acceptance.

Cancellation and refunds

• Cancellation requests must be submitted to info@bsides.sydney.
• More than 90 days before the event: full refund less reasonable unrecoverable costs, capped at 10% of the sponsorship fee.
• 31–90 days before the event: 50% refund.
• 30 days or fewer before the event: no refund.
• If the package is resold, the Organiser may provide an additional refund after reasonable costs and delivered benefits are deducted.
• If the Organiser cancels and does not reschedule the event, the sponsorship fee will be refunded in full.
• If the event is postponed, sponsorship transfers to the replacement date. A Sponsor unable to attend may request a full refund within 14 days of notification.
• For a material format change, the Sponsor may accept revised benefits or request a refund less the reasonable value of benefits already delivered.
• Nothing in this agreement excludes rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
